"The judge found that if the jury believes that, that would be an unconstitutional policy of the City of Boston."
"The judge found that a jury could find the incident commander authorized police officers to use force indiscriminately on all who remain present after 9:15,"
"At 9:15, there were many peaceful people who came from the suburbs who were trying to leave but couldn't figure out how to do so."
A federal judge permitted a civil rights lawsuit by four protesters alleging excessive force by three Boston police officers on May 31, 2020, to move forward toward trial. The protesters — Jasmine Huffman, Justin Ackers, Caitlyn Hall, and Benjamin Chambers-Maher — attended a Black Lives Matter demonstration that became violent later in the night. Allegations include baton strikes by Officer Michael Burke and Edward Nolan and pepper spray used by Officer Michael McManus. The judge found a jury could conclude the incident commander authorized indiscriminate force after 9:15, and that such a finding could imply an unconstitutional city policy. Judge Allison Burroughs denied Burke’s summary judgment motion; the city’s motion was granted in part on claims tied to written policies, supervision, and training.
