An immigration judge denied bail to City Council data analyst Rafael Andres Rubio Bohorquez on Feb. 2, after a brief hearing at Varick Street immigration court. Bohorquez remains in ICE custody at Orange County Jail following a Jan. 12 arrest at an asylum interview in Bethpage, Long Island. Federal attorneys cited a 2023 roommate dispute that produced sealed charges and alleged Bohorquez misstated his arrest history in immigration filings. Defense counsel Roger Asmar said the omission resulted from the sealing and maintained video evidence undermines the assault allegation. Numerous City Council officials sought his release. A federal habeas corpus case remains pending.
