A Canadian court has stopped the deportation of nonbinary individual Angel Jenkel to the U.S. due to concerns over the hostile environment for transgender and nonbinary individuals under the Trump administration. Jenkel, who is a primary caregiver for their fiancé with epilepsy, overstayed their visa to provide support. The court found the previous risk assessment flawed, as it relied on outdated data. Justice Blackhawk recognized the deteriorating conditions for transgender individuals and noted the significance of Jenkel's caregiving role in the ruling.
Blackhawk noted this hostile climate as well as Jenkel's role as their fiancé's primary caregiver as reasons to halt the deportation.
Blackhawk's ruling is "a marked recognition that the conditions have deteriorated ... since the Biden administration has left office," said Sarah Mikhail.
The risk assessment was "flawed and unreasonable," Blackhawk wrote in her ruling, noting that it relied on outdated information.
Donald Trump has issued executive orders denying the existence of trans and nonbinary people, ordering their expulsion from the military.
