However, Empire State Development is postponing the assessment of fines that Greenland USA would have had to pay - $2,000 per month for each unit that never got constructed.
The project received a go-ahead from the NY State Court of Appeals in 2009 after a fight between the city and community groups over eminent domain - the government's right to seize private property for development.
