BREAKING: Block On Trump Birthright Order Upheld Over Trump Appointee's Dissent
Briefly

An appeals court upheld an injunction blocking President Trump's birthright citizenship executive order due to its unconstitutional nature. The 9th U.S. Circuit Court of Appeals ruled against the order that sought to deny citizenship for children born to undocumented or temporarily present individuals. Judge Patrick Bumatay dissented, arguing the state lacks standing in the case. This decision follows a previous ruling which also blocked the order in New Hampshire, and it brings the issue closer to a potential hearing before the Supreme Court.
The 9th Circuit blocks the Trump administration from enforcing the order that would deny citizenship to children born to people who are in the United States illegally or temporarily.
The ruling from a divided panel of the 9th U.S. Circuit Court of Appeals comes after Trump's plan was also blocked by a federal judge in New Hampshire.
The district court correctly concluded that the Executive Order's proposed interpretation, denying citizenship to many persons born in the United States, is unconstitutional.
Judge Bumatay wrote in a 29-page partial concurrence and partial dissent that he believed the state do not have standing in the case.
