A grand jury refusing to indict someone, which is a much lower bar than a trial, is pretty rare. But this is now the second time, the Justice Department has tried to prosecute James for alleged mortgage fraud and not had it work out."
A federal grand jury in Virginia declined to re-indict New York Attorney General Letitia James on alleged mortgage fraud charges. The refusal followed a prior dismissal after a judge threw out the first case because of the improper appointment of interim U.S. attorney Lindsey Halligan. A different prosecutor was assigned for the second attempt, which also failed to secure an indictment. The decision constitutes a rare grand jury refusal and marks the second unsuccessful prosecution effort by the Justice Department targeting James. President Trump has publicly criticized James since her civil case against him and his company.
