DOJ Plans to End Sexual Violence Protections for Incarcerated LGBTQIA+ People
"The memo, dated Dec. 2, takes aim at existing standards of the Prison Rape Elimination Act (PREA) that the department says do not comport with the Trump administration's first-day executive order that, among other things, targeted protections for trans people behind bars. PREA was passed in 2003, and President Barack Obama added new protections for LGBTQIA+ people to the DOJ's PREA rulebook in 2012."

Facilities operated by other agencies, such as the Department of Homeland Security, are subject to their own detention standards."
A Department of Justice memo dated Dec. 2 targets PREA standards that the department says conflict with a Trump administration first-day executive order that limited protections for trans people behind bars. PREA was enacted in 2003 and received additional LGBTQIA+ protections in DOJ rules in 2012. The proposed changes would apply to all facilities subject to PREA, including adult prisons and jails, lockups, community confinement facilities such as halfway houses, and juvenile facilities operated by government or nonprofit entities. Facilities run by other agencies, including the Department of Homeland Security, follow separate detention standards. DOJ-certified PREA auditors received the memo and were instructed to disregard the challenged standards.
