The Trump DOJ indictment of former FBI Director James Comey is incoherently drafted and fails to fulfill an indictment's constitutional purpose. The case against Comey is so ill-conceived that increased scrutiny only makes it weaker. The indictment cannot establish beyond a reasonable doubt that Senator Ted Cruz was referring to someone other than Andrew McCabe, nor that Comey understood and willfully lied about such a reference. The indictment is inadequately pleaded and factually without foundation and should be dismissed. Prior prosecutors hand-selected by the Trump administration examined the case and declined to bring charges. Perjury prosecutions are difficult and concerns exist about political pressure.
